Terms of Service

These Terms of Service ("Terms") govern your use of the Zulu Aviation iOS application ("App") and website ("Site"). By using the App or Site, you agree to these Terms.

If you do not agree, do not use the App or Site.

1. Definitions

• "We", "Us", "Our": Jack Nicholas Wilkinson, trading as Zulu Aviation
• "You", "Your": The user of the App or Site
• "App": The Zulu Aviation iOS application
• "Site": zuluaviation.co.uk and all associated pages
• "Services": All features and functionality provided by the App and Site

2. Acceptance of Terms

By creating an account or using the App, you:

• Confirm you are at least 13 years old
• Agree to comply with these Terms
• Agree to comply with applicable aviation laws and regulations
• Accept our Privacy Policy

3. Aviation Safety Disclaimer

You acknowledge and agree that:

• You remain solely responsible for compliance with all applicable aviation laws and regulations
• Weather data (METAR/TAF) is for convenience only and may be delayed, incomplete, or unavailable
• You must not use the App as a primary source for flight safety decisions
• The App does not replace official pilot logbooks or documentation required by aviation authorities
• You are responsible for verifying all logbook entries are accurate before using them for official purposes

4. Account Registration

To use the App, you must:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activity under your account

We reserve the right to suspend or terminate accounts that violate these Terms or are inactive for extended periods.

5. Your Content (Logbook Data)

Ownership

You retain ownership of all data you enter, upload, or import ("User Content"). This includes flight entries, aircraft data, and profile information.

License to Us

By using the App, you grant us a limited, non-exclusive license to store and process your User Content solely to provide the Services. This license ends when you delete your account.

Your Responsibilities

• Ensure all entries are accurate and truthful
• Do not enter data you don't have the right to store
• Do not enter illegal, offensive, or infringing content
• Verify data complies with your aviation authority's requirements

6. Subscriptions & Payment

Subscription Plans

• Free: Limited to 10 flights and 1 aircraft
• Pro Monthly: £3.99/month, billed monthly
• Pro Annual: £29.99/year, billed annually (37% savings)

Apple In-App Purchases

All subscriptions are processed through Apple's In-App Purchase system. By subscribing, you agree to:

• Apple's Terms of Service
• Automatic renewal unless cancelled 24 hours before renewal
• Billing through your Apple ID
• Managing subscriptions through iOS Settings → Apple ID → Subscriptions

Refunds

Refund requests must be submitted to Apple, not to us. We cannot process refunds for In-App Purchases. Apple's refund policy applies.

Price Changes

We may change subscription prices at any time. Price changes apply to new subscriptions and renewals after 30 days' notice.

7. Acceptable Use

You must not:

• Violate any laws or regulations
• Infringe others' intellectual property rights
• Attempt to hack, reverse engineer, or compromise security
• Use the App for unauthorized commercial purposes
• Upload malicious code or spam
• Impersonate others or provide false information
• Share your account with others

8. Intellectual Property

The App, Site, branding, and all content are owned by us or licensed to us. You receive a personal, non-exclusive, non-transferable license to use the App as intended.

You may not:

• Copy, modify, or distribute the App
• Reverse engineer or extract source code (except as permitted by law)
• Use our trademarks without permission
• Create derivative works

9. Service Availability

We strive for 99.9% uptime, but we do not guarantee:

• Uninterrupted access to the App or Site
• Error-free operation
• Compatibility with all devices
• Availability of third-party services (weather data, etc.)

We may:

• Update, modify, or discontinue features at any time
• Perform scheduled maintenance with notice when possible
• Suspend services for security or legal reasons

10. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• The App and Site are provided "AS IS" and "AS AVAILABLE"
• We make no warranties, express or implied
• We do not warrant that the App will meet your requirements
• We do not warrant that data will always be backed up or recoverable
• Weather data may be inaccurate, delayed, or unavailable

11. Limitation of Liability

NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE EXCLUDED UNDER UK LAW (including liability for death or personal injury caused by negligence, or fraud).

Subject to that, and to the maximum extent permitted by law:

• We are not liable for losses arising from reliance on the App for aviation operational decisions
• We are not liable for indirect, consequential, or special damages
• Our total liability is limited to the amount you paid for subscriptions in the 12 months preceding any claim (if any)

12. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from:

• Your use of the App or Site
• Your violation of these Terms
• Your violation of any laws or regulations
• Your User Content

13. Termination

By You

• You may stop using the App at any time
• You may delete your account from the App settings
• Subscriptions continue until cancelled or expired

By Us

We may suspend or terminate your account if you:

• Violate these Terms
• Engage in fraudulent activity
• Pose a security risk
• Request account deletion

Upon termination, your right to use the App ends immediately. We will delete your data within 30 days (see Privacy Policy for retention details).

14. Changes to Terms

We may update these Terms from time to time. If we make material changes:

• We will update the "Effective Date" above
• We may notify you via email or in-app message
• Continued use after changes means you accept the updated Terms

15. Governing Law & Disputes

• These Terms are governed by the laws of England and Wales
• Disputes will be resolved in the courts of England and Wales
• If any provision is unenforceable, the rest remains in effect
